Introduction
These Terms of Service ("Terms") govern the relationship between you and Jack-Jack Studios LLC, a Colorado limited liability company ("Jack-Jack Studios," "we," "us," or "our"), regarding your access to and use of our games, websites, and related services (collectively, the "Service").
The Service is also governed by our Privacy Policy, which is incorporated by reference.
By installing, accessing, or using the Service, you agree to be bound by these Terms and the Privacy Policy. If you do not agree, do not install, access, or use the Service.
Use of the Service is void where prohibited.
Eligibility
You must be at least 13 years old to use the Service.
If you are between the ages of 13 and 17, you represent that your legal guardian has reviewed and agreed to these Terms on your behalf.
The Service is not directed to children under the age of 13. Parents and guardians are encouraged to monitor their children's use of the Service and to use device-level parental controls where appropriate.
If you access the Service through a third-party platform or social networking service ("SNS"), you must also comply with that platform's applicable terms.
Important Notice -- Arbitration
For users located in the United States and Canada, these Terms include a mandatory arbitration agreement and class action waiver. Please review Section 8 carefully.
Changes to These Terms
We may update these Terms from time to time. Updates will be communicated through in-game notices, website postings, or other reasonable means.
Your continued use of the Service after any update constitutes acceptance of the revised Terms. If you do not agree, you must discontinue use of the Service.
1. License
1.1 Limited License
Subject to your compliance with these Terms, Jack-Jack Studios grants you a non-exclusive, non-transferable, non-sublicensable, revocable, limited license to access and use the Service solely for your personal, non-commercial entertainment purposes.
1.2 Accounts
The Service may use accounts, including anonymous accounts provided through Unity Game Services. Certain features--such as cloud saves, in-app purchases, or account portability--may require linking an account to a third-party platform such as Google Play Games or Apple Game Center.
Some features described in these Terms may not be available in all games or at all times.
You agree that you will not:
- Create or use an account if you are under 13
- Sell, transfer, rent, or share your account
- Use false or misleading information
- Use the Service if you have been previously banned or removed
You are responsible for all activity associated with your account, whether authorized by you or not.
1.3 Account Security
You are responsible for maintaining the confidentiality of any login credentials associated with your account. Jack-Jack Studios is not responsible for losses resulting from unauthorized account access.
1.4 License Restrictions
You agree that you will not, under any circumstances:
- Use cheats, bots, exploits, hacks, mods, or unauthorized third-party software
- Reverse engineer, decompile, or attempt to extract source code
- Interfere with or disrupt servers or services
- Upload malicious code
- Harass, abuse, threaten, or harm other users or Jack-Jack Studios staff
- Post unlawful, obscene, defamatory, hateful, or infringing content
- Collect or share personal information of other users
Violation of these restrictions may result in immediate suspension or termination.
2. Suspension and Termination
Jack-Jack Studios may suspend, restrict, or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or engaged in improper or unlawful behavior.
Upon termination, you may lose access to all associated content, virtual items, or progress. Jack-Jack Studios is not obligated to provide compensation or refunds.
3. Ownership
3.1 Service Ownership
All rights, title, and interest in the Service--including games, software, artwork, audio, characters, content, and systems--are owned by Jack-Jack Studios or its licensors.
3.2 Accounts and Virtual Items
Accounts and all associated virtual items, currency, or benefits are licensed, not sold. You have no ownership interest in them.
We may modify or discontinue virtual items or features at any time.
4. User Content
4.1 Responsibility
You are solely responsible for any content you submit or transmit through the Service.
4.2 Monitoring
Communications made through public or in-game features (such as chat) may be monitored or recorded for moderation, safety, or compliance purposes, as permitted by law.
We reserve the right to remove or restrict access to User Content at our discretion.
4.3 License to User Content
By submitting User Content, you grant Jack-Jack Studios a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, distribute, and display such content in connection with the Service.
5. Purchases and Virtual Items
5.1 Purchases
The Service may offer in-app purchases, including virtual currency or items. All purchases are final and non-refundable except as required by applicable law or platform policies (such as the Apple App Store or Google Play).
5.2 Pricing
Prices and availability may change at any time. We are not obligated to provide refunds for unused virtual items.
6. Third-Party Advertising
The Service may display advertisements from third parties. Information related to advertising practices is described in our Privacy Policy.
7. Disclaimers and Limitation of Liability
7.1 Disclaimer
The Service is provided "as is" and "as available" without warranties of any kind.
7.2 Limitation of Liability
To the maximum extent permitted by law, Jack-Jack Studios shall not be liable for indirect, incidental, consequential, or punitive damages.
Our total liability shall not exceed the amount you paid to Jack-Jack Studios in the six (6) months prior to the claim.
8. Dispute Resolution and Arbitration
8.1 Informal Resolution
Before initiating arbitration, the parties agree to attempt informal resolution for at least sixty (60) days.
8.2 Arbitration
Any unresolved dispute shall be resolved by final and binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules.
8.3 Exceptions
Claims involving intellectual property, piracy, small claims court matters, or claims not subject to arbitration as a matter of law are excluded.
8.4 No Class Actions
Disputes must be brought on an individual basis only.
9. Governing Law
These Terms are governed by the laws of the State of Colorado, excluding conflict-of-law principles. Arbitration is governed by the Federal Arbitration Act.
10. Miscellaneous
- Severability: Invalid provisions do not affect the remainder
- Assignment: Jack-Jack Studios may assign these Terms without restriction
- No Waiver: Failure to enforce is not a waiver
- Force Majeure: We are not liable for events beyond our control
- Statute of Limitations: Claims must be brought within one (1) year
